Neighbours from hell complain about everything! HELP!

We live in Surrey and have recently bought 3 chickens. They are very sweet and no hassle! We put them in the furthest corner away from our nightmare neighbours in our 80 ft garden!
They have 3 times now out of 2 months that we have had them, clucked at 5-30 am for a few minutes! It's only one of them and we don't even hear them and our bedroom window is ALOT closer to them than the neighbours! 4 weeks ago when this chicken first did it he phoned us and shouted down the phone that every time the chickens wake him he is going to wake us!
Yesterday morning they clucked at 5.10am. HE called our phone, which we didn't answer. He then proceeded to bang for 5 minutes on our sons bedroom wall, he is 6 YRS OLD and has special needs! He then bagged on the only other party wall on the landing for another 5 minutes!
This morning the chicken obviously clucked again and this rime he was banging the knocker on our front door and ringing our bell! We ignored him and so he went back to banging my sons wall. We have had lots of problems with these neighbours and as you can tell we don't get on at all!
I am feeling very intimidated and really don't know what to do. These people are NOT reasonable so talking is out of the question. We have had to go legal with the over fence issues!
Hubby spoke to the council yesterday and they said it's no different to a bird making a noise which can't be stopped. We don't have a cockerel!! The council said they could fill in a noise form recording when/how long etc and we told then they would un doubtedly say it was EVERYDAY and lie but they said they would then record so they would be caught out!
Any suggestions anyone?!?!
 
I would have thought this is a police matter as he is clearly harassing you. I would talk to them and consider calling 999 next time so he can be caught in the act.
Good luck-I can understand how intimidated you must feel and NO ONE has the right to do this to you.
He's an irrational bully!

I feel so sorry for you.I would do with the advise newtoduck.They mental and you should be protected from them.
 
Police absolutely...... make that call and they can issue YOU with a noise-o-meter and YOU can record and have clear concise information should you decide to go legal over harassment and show them just how little noise your gals do indeed make.
Other than than I would just blooming move love, its only bricks and mortar at the end of the day, what an absoulute horror of a neighbour

and you could record HIM banging and shouting, to compare the noise levels of chicken and neighbour!

Do you think things may calm down a bit when the darker evenings/mornings arrive and she wakes up later? Or could you perhaps keep the pophole closed until 7.00? I agree with what you're doing at the moment, ie letting them get up when they're ready, but to reduce aggro maybe a bit later might help?
 
This is intimidation and threatening behaviour without any doubt. Call the Police and report it now! If he has an alleged issue with noise he will need to prove it and there are proper council proceedures set out for this. Unforunately if you do move and go on record as making a complaint you are legally obliged to disclose this to any prospective buyer. You may find if the Police visit he will stop.
Council has to record noise as being of sufficient volume and then witness it happening. The diary sheets determine the frequency and time before they consider recording -normally 6 weeks.
 
Clearly your neighbours make much more noise than either you or your chickens do! I feel for you and agree with other members that you should call the police if they are harassing you. What a bunch of nutters, any normal person would just turn over and go back to sleep. I really hope you manage to get things sorted.
 
Not Chicken related but I have neighbours from hell aswell. Not much you can do about them but contact the Police- Contact the local council and keep your own records of their Behaviour. Keep a record of each time your chickens make a noise aswell.

But if they are disturbed by your chickens- what happens with other noises in the area. Seagulls and dogs are our problem locally (Besides the Neighbours from Hell)

On your chickens- I take it they are locked in the coop overnight. If they still make a noise- try cutting out light that can get to them to keep them resting longer.
 
Hi I just wanted to add that you should record an fonecall from him with all abuses he says(you do not heve to lisen just put next to the recorder.If you have camcorder record hes banging on the walls and doors,and then you can use all this as evidence agains him.I have lovely naighbours around here-they all love my chickens,but I do not let my chickens out earlier than 8.00,my cockrel makes so much noise when he gets out and I do not wanna upsed anyone.Meybe you could try this too.I hope your neighbors get to their senses and stop makig so much fuss over nothing.
 
I would ring your local council (I did) just to make sure of local bylaws on chicken keeping.
Surrey Heath Borough Council told me there are no by-laws, even about the cockerel in question, they told me I was more than reasonable keeping him quiet until 9.30a.m.!! It was good to know that the law was on my side.
Can you not get your obviously insane neighbours locked up?, it sounds to me as if you could with a little effort.
 
Thanks all! I have contacted our local PCSO and he went and had a 'chat' with them. He told them they can not harass us like this and if they are unhappy they need to fill in the noise nuisance form from the council, to which to wife replied we have printed one off today!!!! He then told them he will be telling us to do the same after the grief they have given us.
So now we wait......this morning the chickens were quiet but I have no doubt they will report otherwise!!! In fact I would lay money on it that they report it's everyday for 30 mins etc! NIGHTMARE! What concerns me is how will the council prove otherwise AND even with their recording device, what is there to stop them hanging out of the window to make the noise louder! I am stressed! Does anyone know what is likely to happen?!?!
 
If you really worry so much keep them in the cop untill 8AM after that time You can even drill in the wall.All builders start around that time .You have to do what you have to do and they can't do anything.No worries people usually more tolerant than them:)
 
Hi Baggles. Reference my earlier post to you and my own post Noise Nuisance Notification . The nuisance must be witnessed by the council. So diary sheets -6 weeks, recording machine follows -2 weeks, then witness turns up whenever. You will then be advised if it constitutes a nuisance in their opinion. If you disagree they will gather more evidence and take you to court. If they win, the court will issue a Noise Abatement Order. If you ignore it the Council will need to gather more evidence and then take action for breach of the Order. Whole process could take 12 months. Of course dark mornings are coming so the process may start but be abandoned and closed by the Council.

Is it def 6 wks as the paperwork I downloaded from the council say "keep diaries for at least 2 weeks or 6 entries"!!!!
 
Ours wants 4 weeks minimum, plus admin delay both ways. In my experience 6 - 8weeks. Then recorder goes in and they have to collect and review. Then they may contact you to say they belive there is a nuisance -in your case I don't believe there is. Are there any other noises at that time that are as loud -like cars, lorries, aircraft, dogs, wild birds? Then they need a witness. Then will issue 7 day noise abatement notice. Then they have to go to court. Then if they do win and you don't do anything, more evidence and back to Court for a breach. Have the Council actually notified you of their investigation yet? Ours have and also told us to do nothing as it is only alledged.
We have turned our coop around so that the air vent faces away and it has made a big difference. Can't really hear cockerel at 50 yards now.
 
I started reading this thread and got agitated almost imediateley. I then read on to see what fine advice you've been getting. I have run a massive neighbourhood watch for decades (on and off) and can only say that along with the other good stuff, chrismahon has a very firm grip on things.
Start making a diary of his anti social behaviour at the very least ... It is amazing how socialy inept numpties resport with violent words and attitudes so quick...... damn plonkers imho. Keep the moral high ground and your composure .... you'll win on this one (jmho)

You gotta love the fact that the seasons are in your favour.... rofl... he'll have no case... and if he tries he'll be caught out fibbing ... even the most clucky hen wont be "egg proud" or whatever is her issue, if it's dark in the AM :lol:
 
Thank you everyone! The whole season thing does make us smile too! Funnily enough the chickens haven't clucked at 5 am since. The earliest they have done it is at 8.30am! I so wanted to shout through the wall, 'GO WRITE THAT TIME DOWN NOW" T****R!!! lol

Will see what happens, I almost want the chickens to cluck now just to wind them up! Lol
 
Yes we're smiling as well because our noise nuisance investigation now hasn't any evidence. The 4.30 -5.00am am claimed calls are now occurring 5.30 -6.00am, the same time as the very noisy A38 alongside starts getting very noisy. And that assumes they are loud enough to have been a nuisance anyway. If the noise level from your hens is exceeded by the noise level from anything else at that time there is no case. The fact that they may dislike the nature of the noise does not itself constitute a nuisance.

You could always put a light on in the coop for a few minutes to start them early occasionally.
 
5 weeks now since we received our notice of potential noise nuisance and had nothing since. Presume you haven't heard anything else yet either?
